Terms of Service

1.1 These Terms of Service (hereinafter "Terms") govern the use of the SwingRoad online platform (hereinafter "Platform", "Service" or "we") at swingroad.co.uk and all associated subdomains.

1.2 By registering or using the Platform, you accept these Terms in full. Deviating terms from users are not recognised.

1.3 These Terms apply in their current version. Changes will be communicated in accordance with Section 12.

2.1 SwingRoad is an online platform for adults that allows registered users to:

• •Create and manage a personal profile
• •Browse and view profiles of other users
• •Communicate with other users through the platform
• •Participate in events and activities
• •Use additional premium features (paid)

2.2 The provider reserves the right to change, expand or restrict the functionality of the platform at any time.

2.3 There is no entitlement to uninterrupted availability. Maintenance and technical issues may cause temporary restrictions.

3.1 By registering, you confirm that:

• ✓You are at least 18 years old
• ✓You have full legal capacity
• ✓Your information is truthful and complete
• ✓You are acting of your own free will
• ✓You understand the nature of the services offered

3.2 There is no entitlement to registration. The provider reserves the right to reject registrations without giving reasons.

3.3 Each user may only maintain one account. Creating multiple accounts is prohibited and may result in all accounts being blocked.

3.4 The provider reserves the right to require age verification.

4.1 Users agree to:

• ✓Provide only truthful and current information
• ✓Respect the privacy of other users
• ✓Keep login credentials confidential and not share them
• ✓Comply with all applicable laws
• ✓Behave respectfully and courteously towards other users

4.2 The following is prohibited:

• ✗Uploading child sexual abuse material or content harmful to minors (criminal offence under UK law)
• ✗Harassment, threats, stalking or coercion of other users (criminal offences under the Protection from Harassment Act 1997)
• ✗Identity theft or impersonation
• ✗Distribution of hate speech, racist or discriminatory content
• ✗Commercial use without permission (advertising, prostitution, escort services)
• ✗Distribution of spam, viruses or malware
• ✗Unauthorised access to systems or data (Computer Misuse Act 1990)
• ✗Automated extraction of user data (scraping)
• ✗Sharing personal data of other users with third parties

5.1 Users retain all copyright in content they upload (text, images, videos).

5.2 By uploading content, users grant the provider a non-exclusive, worldwide, royalty-free and transferable right to use, display, store and process such content in connection with the service.

5.3 Users are solely responsible for all content they upload and warrant that they have all necessary rights.

5.4 The provider reserves the right to remove content without notice that violates these Terms, applicable law or public decency.

6.1 Paid Services

In addition to free basic membership, SwingRoad offers paid premium features. Current prices are displayed on the platform and include VAT at the applicable rate.

6.2 Contract Formation

The contract for paid services is formed by selecting the desired subscription and confirming payment.

6.3 Payment Processing

Payment is processed through our payment service provider. The provider does not store credit card details.

6.4 Automatic Renewal

Subscriptions renew automatically for the selected period unless cancelled before the end of the current term. Cancellation must be made at least 24 hours before expiry.

6.5 Cancellation

Subscriptions can be cancelled at any time through account settings. Cancellation takes effect at the end of the current billing period.

6.6 Price Changes

The provider reserves the right to change prices. Price changes only apply to new subscriptions or renewals after the change date.

7.1 Exercising Your Cancellation Right

To exercise your right to cancel, you must inform us by a clear statement (e.g., by email to support@swingroad.co.uk) of your decision to cancel this contract.

7.2 Effects of Cancellation

If you cancel this contract, we will reimburse all payments received from you without undue delay and no later than 14 days from the day on which we receive notice of your cancellation.

8.1 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

8.2 Subject to clause 8.1, we will not be liable for any indirect, incidental, special, consequential or punitive damages.

8.3 The provider is not liable for:

• •The conduct of other users on or off the platform
• •The accuracy of user information
• •Technical disruptions or outages
• •Data loss not caused by the provider
• •Indirect damages or lost profits

8.4 Your statutory rights as a consumer are not affected.

9.1 Termination by User

Users can delete their account at any time through account settings or by email to support@swingroad.co.uk.

9.2 Termination/Suspension by Provider

The provider reserves the right to suspend or delete user accounts for:

• •Breach of these Terms
• •Illegal or harmful behaviour
• •False information during registration
• •Repeated complaints from other users
• •Suspected fraudulent activity

9.3 Consequences of Termination

• •Access to the account will be blocked
• •Amounts already paid will not be refunded
• •Personal data will be deleted in accordance with our Privacy Policy

11.1 All content on the platform (design, logos, text, software, graphics) is protected by copyright and is the property of the provider or its licensors.

11.2 Use of the platform does not grant users any rights to the provider's intellectual property.

11.3 The SwingRoad name and logo are trademarks of DDreamLab Ltd.

12.1 We may update these Terms from time to time. We will notify you of significant changes by email or through a notice on our website at least 30 days before they take effect.

12.2 If you do not agree to the new Terms, you may terminate your account before they take effect. Continued use of the platform after the effective date constitutes acceptance of the new Terms.

13.1 These Terms are governed by English law. You can bring legal proceedings in respect of these Terms in the English courts.

13.2 If you are a consumer resident in Scotland, you can bring legal proceedings in either the Scottish or the English courts. If you are a consumer resident in Northern Ireland, you can bring legal proceedings in either the Northern Irish or the English courts.

13.3 As a consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions of local law.
