Terms of Service

1.1 These Terms of Service ("Terms") govern your use of the SwingRoad platform ("Platform", "Service", or "we") accessible at swingroad.co.uk and all associated subdomains.

1.2 By registering for or using the Platform, you agree to be bound by these Terms in full. If you do not agree to these Terms, you must not use the Platform.

1.3 These Terms are governed by the laws of England and Wales. If you are a consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident.

2.1 SwingRoad is an online platform for adults that enables registered users to:

• •Create and manage a personal profile
• •Browse and view profiles of other users
• •Communicate with other users through the platform
• •Access additional premium features (after the beta)

2.2 We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.

2.3 We do not guarantee uninterrupted availability of the Platform. Maintenance and technical issues may cause temporary service interruptions.

3.1 By registering, you confirm that:

• ✓You are at least 18 years of age
• ✓You have full legal capacity to enter into this agreement
• ✓All information you provide is truthful and accurate
• ✓You are acting of your own free will
• ✓You understand the nature of the services offered

3.2 We reserve the right to refuse registration without giving reasons.

3.3 Each user may only maintain one account. Creating multiple accounts is prohibited and may result in termination of all accounts.

3.4 We may ask you to complete an age check at any time. An age check is required before you can share or view adult content (see section 4A).

4.1 You agree to:

• ✓Provide only truthful and current information
• ✓Respect the privacy of other users
• ✓Keep your login credentials confidential
• ✓Comply with all applicable laws
• ✓Treat other users with respect and courtesy

4.2 You must not:

• ✗Upload any illegal content, including child sexual abuse material
• ✗Harass, threaten, stalk, or intimidate other users
• ✗Impersonate others or create false identities
• ✗Post hateful, racist, or discriminatory content
• ✗Use the Platform for commercial purposes without authorisation (advertising, prostitution, escort services)
• ✗Distribute spam, viruses, or malware
• ✗Attempt unauthorised access to systems or data
• ✗Scrape or automatically collect user data
• ✗Share other users' personal data with third parties

4A.1 You may share sexually explicit images only in your private photos, and only images of yourself (or, on a couple's profile, of you and your partner with their consent). Explicit images must not be used as a profile photo or in public photos.

4A.2 We use automated technology (Google Cloud Vision SafeSearch) to check every new photo for explicit content before anyone else can see it, and we may also review photos manually. Explicit photos are never shown in the public parts of SwingRoad (profile photo, public gallery, feed and search). A photo detected as explicit can be kept only in your private photos, where it stays hidden until you complete a one-time age check with our provider Didit (ID document and live selfie); or you can publish a strongly blurred copy on the website, which is checked again. We may apply the same check to photos that are already public.

4A.3 Explicit content is shown only to members who have completed an age check. In the United Kingdom this is required by the Online Safety Act 2023. To view other members' 18+ content, you complete a one-time age check (facial age estimation or, where needed, an ID document and selfie).

4A.4 You must never upload images of anyone under 18, images of any person without their consent, intimate images shared without the consent of the person shown, or content showing violence, coercion or any illegal act. We report child sexual abuse material to the relevant authorities and permanently close the account.

4A.5 If you believe a photo was wrongly classified as explicit, contact support@swingroad.co.uk and we will review it.

4B.1 You can report any profile, photo or message with the "Report" button, or by emailing support@swingroad.co.uk.

4B.2 We review reports and may remove content, restrict features or close accounts. Where appropriate, we tell you what action we have taken.

4B.3 You can complain to us about content on SwingRoad, about action we have taken against your content or account (including decisions made with automated technology), or about how we meet our duties under the Online Safety Act, by emailing support@swingroad.co.uk. We will acknowledge your complaint and respond as soon as we can.

4B.4 If we remove your content or suspend your account and you think we were wrong, you can appeal by emailing support@swingroad.co.uk with your username. A person, not an automated system, will review your appeal.

5.1 You retain all intellectual property rights in content you upload (text, images, videos).

5.2 By uploading content, you grant us a non-exclusive, worldwide, royalty-free, transferable licence to use, display, store, and process that content in connection with the Service.

5.3 You are solely responsible for all content you upload and warrant that you have all necessary rights to such content.

5.4 We reserve the right to remove any content without notice that violates these Terms, applicable law, or community standards.

During the current beta, all features are free. Paid premium features will only be offered after the beta ends, and we will notify you in advance. The terms below apply only from that point.

6.1 Paid Services

In addition to free basic membership, SwingRoad offers paid premium features. Current prices are displayed on the Platform and include VAT where applicable.

6.2 Contract Formation

A contract for paid services is formed when you select a subscription and confirm payment.

6.3 Payment Processing

Payments are processed through our payment service provider. We do not store credit card details.

6.4 Automatic Renewal

Subscriptions automatically renew for the selected period unless cancelled before the end of the current billing period. Cancellation must be made at least 24 hours before renewal.

6.5 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.

6.6 Price Changes

We reserve the right to change prices. Price changes apply only to new subscriptions or renewals after the change date.

7.1 How to Cancel

To exercise your right to cancel, you must inform us of your decision by a clear statement (e.g., by email to support@swingroad.co.uk).

7.2 Effects of Cancellation

If you cancel, we will reimburse all payments received from you without undue delay and no later than 14 days from the day we receive your cancellation notice.

8.1 Nothing in these Terms excludes or limits our liability for:

• •Death or personal injury caused by our negligence
• •Fraud or fraudulent misrepresentation
• •Any other liability that cannot be excluded by law

8.2 Subject to clause 8.1, we shall not be liable for:

• •The conduct of other users on or off the Platform
• •The accuracy of user-provided information
• •Technical failures or service interruptions
• •Data loss not caused by our negligence
• •Indirect, consequential, or special losses
• •Loss of profits, business, or anticipated savings

8.3 If you are a consumer, you have legal rights in relation to services not carried out with reasonable skill and care. Nothing in these Terms affects those statutory rights.

9.1 Termination by You

You may delete your account at any time through your account settings or by emailing support@swingroad.co.uk.

9.2 Termination/Suspension by Us

We reserve the right to suspend or terminate accounts for:

• •Breach of these Terms
• •Illegal or harmful conduct
• •False information provided during registration
• •Repeated complaints from other users
• •Suspected fraudulent activity

9.3 Effects of Termination

• •Access to your account will be revoked
• •Amounts already paid are non-refundable
• •Personal data will be deleted in accordance with our Privacy Policy

11.1 All Platform content (design, logos, text, software, graphics) is protected by intellectual property rights and owned by us or our licensors.

11.2 Your use of the Platform does not grant you any rights in our intellectual property.

11.3 You may not copy, modify, distribute, or create derivative works from any Platform content without our prior written consent.

12.1 We reserve the right to modify these Terms at any time.

12.2 Material changes will be notified via email or Platform notification at least 14 days before taking effect.

12.3 Continued use of the Platform after changes take effect constitutes acceptance of the modified Terms.
